A. Overview

At AG Interactive, Inc. ("AG," "we"), protecting your privacy and security is a top priority. We have adopted the following privacy policy (the "Privacy Policy") to advise you of our use of your personal information collected as part of your use of the Boofle application ("App") and its associated website ("Website", which together with the App shall be referred to herein as "Boofle"), and your choices regarding that use. Boofle allows users to receive, create, post, share, and communicate content, messages, images, photos, and other material across digital communication platforms and social network environments (the "Content"). This Privacy Policy describes what types of information we gather about you, how we use it, under what circumstances we disclose it to third parties, and your rights to change or delete it. By downloading or using the App or visiting the Website, you acknowledge that you have read, understand, and agree to be bound to this Privacy Policy and to comply with all applicable laws and regulations. If you do not agree to this Privacy Policy, please do not use Boofle.

B. Scope of Privacy Policy

This Privacy Policy only applies to Boofle, which consists of the App and the Website, and not to other AG services, mobile applications or websites. This Privacy Policy applies to information collected through the use of Boofle, and applies to all users of Boofle, including each sender of the Content (the "sender") and each recipient of the Content (the "recipient"). This Privacy Policy does not apply to the websites or applications of other companies or organizations, even if we include links to those websites or applications in Boofle. You should carefully review the privacy policies of those third-party websites or applications to determine how they treat your personal information.


A. When You Send Content Electronically

When a sender uses Boofle to send Content electronically, we may collect the sender's e-mail address and the recipient's e-mail address or SNS account information (as addressed below). This information is necessary to send the Content and provide confirmation, if applicable, that it has been received.

As a sender, it is important that you have received the consent of the recipient to receive Content by e-mail. Except as set out in this Privacy Policy, we do not use the recipient's information for any purpose other than to send the Content.

PLEASE NOTE: Our services and products are neither intended nor appropriate for anonymous communications, and such activity is expressly prohibited by the acceptable use policy in our Terms of Service.

B. Aggregate Data

We gather certain aggregate, de-identified information about the use of Boofle, such as the frequency with which you open the App or visit the Website, and the content that you favor. We may collect information from you based on the application or applications that you elect to use from us. For example, we may track how much time you spend using the Application.

These statistics are very much like television ratings that tell the networks how many people tuned in to a program. We only use this type of data in aggregate--that is, we look at the data on a collective basis, in summary form, rather than on an individual basis. This data helps us determine the extent to which our users use certain aspects of Boofle, which, in turn, enables us to make Boofle as appealing as possible. This data does not contain any personally identifiable information about you.

We may also use the geographic location provided by your device to notify you of stores or products near you. This location is not tied to your personally identifiable information, and you may, of course, prevent the use of your location through your device settings. We will not use your location data for any other purpose and do not disclose it to third parties.

C. Technology We Use To Gather Data

When you download the Application, we use software code to collect technical information about your device, including the type of device it is and the operating system it uses, and your use of the Application. By using the Application, we are seeking to obtain your consent to do this. We may engage third parties to collect this information.

When you visit the Website, we ask your browser to store small text files containing a string of alphanumeric characters known as a cookie. We use both session cookies and persistent cookies. If you have chosen to identify yourself on a Website, we use session cookies containing encrypted information to identify you and facilitate your use of the Website. Session cookies are required to access much of the content and services offered on the Website. After you leave the Website and close your browser, a persistent cookie remains. Persistent cookies can be removed by following your help file directions in your web browser. If you refuse our cookies, some features of the Website may not function properly.

Our servers automatically record certain information (e.g., web request, Internet Protocol ("IP") address, browser type, browser language, URLs, etc) that your web browser sends whenever you visit the Website.

Web Beacons: We may employ clear GIFs or Web Beacons to track anonymously how users use the Website. We may also use Web Beacons in our emails to track which emails are opened by recipients.

D. Interaction with Social Networking Sites (SNSs)

If you are a member of a SNS (such as Facebook), Boofle may enable you to log in through an interface provided by that SNS. Boofle may also enable you to access the SNS through Boofle. If you log in to Boofle using an SNS, or access an SNS through Boofle, we may receive the personally identifiable Information that you have provided (or provide in the future) to that SNS. By connecting Boofle to an SNS in this manner, you consent to Boofle's access and use of this personally identifiable information. You may be able to specify what personally identifiable information is provided by the SNS to Boofle using the privacy settings in your SNS profile information.

We do not store your login information for any SNS.

Please note that any SNS you may choose to use in connection with Boofle is not subject to this Privacy Policy. Any collection of information by an SNS, or use or disclosure of information we provide them, will be subject to their own privacy policy, terms of use or other applicable policy. You should review the information posted by your SNS before deciding to provide information to the SNS or use the SNS in connection with Boofle.

E. User Provided Information

User Provided Information: When you choose to submit personally identifiable information to Boofle (including name, address, telephone number, email address, and date of birth), your information is used only for the specific purpose for which it was submitted, unless you consent otherwise or as required by law. In many cases, you choose the amount of information you supply. There may be instances where some of the information that we ask you to provide is identified as mandatory and some as voluntary. In such cases, if you do not provide mandatory personal information with respect to a particular activity, you will not be able to engage in that activity. We may collect personally identifiable information when you:

  • Upload content;
  • Inquire about our products and services;
  • Create an account;
  • Sign up for email updates or to receive our newsletter and/or advertisements;
  • Enter a contest or sweepstakes;
  • Are referred to us through a marketing promotion; or
  • Participate in a marketing survey, promotion or event.

III. AG's Uses of Information

We will use your information as described in this Privacy Policy. In all circumstances, we will delete your information when that information is no longer required for any of the purposes for which it was collected.

A. Research

We may conduct demographic or other research about Boofle users to determine how users engage with our materials.

B. Business Partners

We may provide information about how our customers collectively use our Application to advertisers, sponsors, and other companies with which we do business ("Business Partners"). This data does not include any personally identifiable information about you.

C. Information Sharing Between Affiliates

We are a member of the American Greetings family. This means we are an Affiliate of American Greetings and its subsidiaries, including but not limited to the Website,,,, and Recycled Paper Greetings. We reserve the right to share your personally identifiable information, including your e-mail, postal address and phone number with our Affiliates, provided that they will only contact you in connection with similar products and services. We may share your personally identifiable information with Affiliates in order to conduct similar promotions, offer special premiums, and share databases and equipment. We will not share credit card information or other payment information with anyone, including Affiliates, without your express permission. We reserve the right to share your information with other companies that become Affiliates of AG.

D. Communications From AG

As a Boofle user, you will be asked if you want to receive exclusive offers from AG and its affiliates. If you opt-in, we will send you exclusive AG offers. From time to time, we may also send you offers for similar products and services from AG, special premiums, or special offers from our Affiliates and our sponsors. We do not share your personally identifiable information with any third parties in connection with these communications.

You can always decline these communications by simply following the "unsubscribe" link at the bottom of each communication.

E. Communications From Our Business Partners

If you have opted-in, we may offer you money-saving coupons, discounts, and promotions from our Business Partners. These communications may come from AG or directly from the Business Partners themselves. If you have opted-in to these communications, we may also share with our Business Partners certain demographic, geographic, preference, and other personally identifiable information we have gathered about you. This will help them in directing offers that are more likely to be of interest to you.

F. Mandatory Communications

Even if you have opted out of email communications, we reserve the right to communicate with you from time to time about important administrative, policy, legal, and financial matters that affect your use of Boofle, including without limitation any alleged violations of our Boofle Terms of Service. These communications are mandatory.

G. Third-Party Information Sharing

Generally, we do not share your information with third parties. We do reserve the right to share your information with third-party companies we may use to perform other service functions for us. However, at all times, we will control and be responsible for the use of your information and will ensure that sufficient contractual mechanisms are in place to ensure that the information remains secure. We do not share equipment or databases with these companies and will not share your credit card information with them without your express permission. Additionally, any company we use for these reasons will not share, sell, or distribute your information, or otherwise use your information except to provide us services.

H. Disclosure Exceptions

We reserve the right to disclose your personal information to appropriate third parties if we are required to do so by law or we reasonably believe that such action is necessary:

  • To comply with legal process such as a search warrant, subpoena or court order;
  • To protect the company's rights and property;
  • To investigate reports of users sending material using a false e-mail address or users sending harassing, threatening, or abusive messages;
  • To protect against misuse or unauthorized use of our Website, products, or services; or
  • During emergencies, such as when we believe someone's physical safety is at risk.

IV. Your Control Over Your Information

A. Opt-Out/Changing Your Status

At any time, you can change choices you have previously made about the use of your personal information. Except for mandatory communications, every communication we send you will contain a clearly worded "Opt-Out" or "Unsubscribe" link allowing you to withdraw your permission for future mailings. Permission changes will be honored promptly after receipt. Please allow five to seven days for processing. Permission changes will not affect any information that you provided to us and that we previously used or disclosed in accordance with your permission.

B. Resolve Issues

If you are concerned about our use of your personal information or wish to have it deleted, please contact us at call us at 800-711-4474 between 9am and 5pm eastern standard time. Please note email is not secure. Do not send personal information over email. We shall have no liability for disclosures due to errors in transmission, user error or third-party actions.


A. Protection For Children -- COPPA Compliance

Boofle is not intended for children under the age of 13. We are committed to protecting the privacy and rights of children online. To that end, we do not collect any personally identifiable information from users whom we know are under the age of 13.

B. Compliance with California Privacy Laws.

If you are a California resident and Boofle user, you are entitled to request certain information regarding our disclosure of certain "personal information" (as defined in California Civil Code Section 1798.83) to third parties for their direct marketing purposes. If you are a California resident and have provided AG with personal information within the last year, you may make such a request by emailing us at and typing the following in the subject line of the e-mail: "California Privacy Rights".

Within 30 days of receiving such a request, we will provide a list of the categories of personal information disclosed to third parties for such third parties' direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. A request may be made no more than once per calendar year and we are not required to respond to requests made by means other than through the e-mail address above.

C. Sale of AG or its Assets

In the event that AG or its affiliates assets or stock are ever sold, acquired, merged, liquidated, reorganized, or otherwise transferred, we reserve the right to transfer our user databases together with any personally identifiable information contained in them, to a third-party acquiring AG's assets. In the event we do so, we will place a prominent notice of the sale on the homepage of our site, with links to information about how you can change your privacy preferences.

D. Data Security

We take steps to protect your personal information. Access to all of your information, not just your personally identifiable information, is restricted in our offices. Employees are granted access on a need-to-know basis (for example, our billing clerk or a customer support representative). Furthermore, all employees are kept up-to-date on our security and privacy practices. Our main servers are operated from a dedicated Internet hosting facility with state-of-the-art physical security features, including smoke detection and fire suppression systems, motion sensors, 24x7 secured access, and video camera surveillance and security breach alarms.

Unfortunately, the transmission of information via the Internet or over mobile networks is not completely secure. Although we will do our best to protect your personal information, we cannot guarantee the security of your data transmitted to and from the App and/or Website or over mobile networks; any transmission is at your own risk. Once we have received your personal information, we will use strict procedures and security features to try to prevent unauthorized access. We ask that any third parties to whom we may transfer your personal information take comparable steps to protect that security.

E. Other Websites

Please be aware that the App and/or Website, as well as email communications from us, may contain links to other websites on the Internet that are owned and operated by third parties. The information practices of those third-party websites are not covered by this Privacy Policy and, therefore, we are not responsible for the content or privacy policies of websites to which our Site links. Before providing any information to any third-party website, we encourage you to review the privacy policies of the other websites to understand their privacy practices.

F. Public Forum

Any information you submit in a public forum (e.g. a blog, chat room, or social network) can be read, collected, or used by us and others, and could be used to personalize your experience. You are responsible for the information you choose to submit in these instances. Though we do attempt to monitor user-posted content, such user-posted material is not subject to this Privacy Policy and you should exercise caution when deciding to disclose any personal information.

G. Changes to the Privacy Policy

We will occasionally update this Privacy Policy in response to changing business circumstances and legal developments. When we modify this Privacy Policy in any material way, a notice will be posted on the Website and the Privacy Policy updated. Further, we will also update the "Last Revised: March 7, 2013" at the top of this Privacy Policy. By continuing to access Boofle after we have posted a modified Privacy Policy or have provided you with notice of a modification, you agree to be bound by the modified Privacy Policy.
